Terms and Conditions

  1. Information on how to enter and prizes form part of these Terms and Conditions.
  2. By participating in the promotion, entrants acknowledge that they have read and understood these Terms and Conditions; and agree to be bound by them. Entries must be submitted in accordance with these Terms and Conditions to be valid.
  3. The promotion commences on 10 May 2023 at 01:00am New Zealand Standard Time (NZST) and entries close on 07 June 2023 at 11:59pm NZST (Promotion Period). No entries will be accepted outside the Promotion Period.
  4. The promotion is only open to "Eligible Entrants". Subject to these Terms and Conditions, an Eligible Entrant is a Team or Club who (a) are based in Auckland, Wellington, Dunedin or Hamilton; (b) is the parent or legal guardian of a child between 14 and 17 years of age at the time of entry (Minor); and (c) submits their entry into this promotion in accordance with these Terms and Conditions.  An Eligible Entrant can be resident outside of Auckland, Wellington, Dunedin or Hamilton however all costs related to getting the Team and associated personnel to the training and match day meeting point locations must be covered by the team(s) and associated personnel
  5. Employees, outsourced staff, managers and directors of the Promoter and its related companies and suppliers and agencies involved in this promotion are not Eligible Entrants, nor are their immediate families.
  6. Only one entry per Team is permitted.
  7. This promotion is a game of skill, and chance plays no part in determining the winners. To enter, an entrant must during the Promotion Period:

    • Have the Minor/Parent/team Coach answer the following question in 100 words or less, and insert the answer into the entry form:

“Tell us in 100 words or less what it would mean for your team or club to join the action.

Or submit a 1 minute or less video telling us what it would mean to your team to be the 2023 Women’s World Cup Ball Kids

  • Provide details of the Team’s previous football/sporting experience and activities.
  1. If an entrant’s contact details change, it is the entrant’s responsibility to notify the Promoter in writing.
  2. All entries become the property of the Promoter.

The entries will be split into four (4) separate pools, one each for Wellington, Auckland, Dunedin and Hamilton. Entries will be judged based on originality and how inspiring the answer to the question is, as well as on the amount and degree of football and/or sporting experience. 

(a) 3 valid entries for Auckland (3 squads of 12) and Wellington (3 squads of 12); and

(b) 2 valid entries for each of Dunedin (2 squads of 12) and Hamilton (2 squads of 12)

as determined by a panel of judges comprising representatives of the Promoter.  The winning team in each City will select the players who make up their final squad.

The Promoter's decisions are final and no correspondence will be entered into. 

  1. By entering this Promotion and accepting any prize should they/their Minor or Team be selected as a winner, entrants acknowledge that usage of the Prize and participation in the travel and experience constituting the Prize, organised by or on behalf of adidas (Activities) involves certain risks, including but not limited to, exposure to and sickness or death from viruses, infectious diseases, Coronavirus and the like, and that any of these may lead to quarantine. All entrants accept and fully assume all such risks and the possibility of personal injury, death or loss of or damage to their property as a result of accepting any prize or any other participation in the Activities, on their own behalf and on behalf of the Minor/Team
  2. The winners will be notified by email at the address nominated in their entry form (unless the entrant has notified the Promoter of a change to their contact details in accordance with clause 8) by 20 June 2023.
  3. Winners will receive:
    • the opportunity for the Winning Team to be a “Ball Kid squad” for three (3) or more matches at the FIFA Women’s World Cup in their nearest city;
    • uniform and footwear for the Squad;
    • meals for the Squad at the allocated matches.

(Prize).

Important: Please note that each Winning Squad will need to be available for all matches being played in the relevant city. However each Winning Squad will be allocated three (3) to four (4), not all, of those matches. In addition, the Squad will be required to:

(a) attend a training day three (3) days prior to the opening game in the relevant city (Training Day); and

(b) meet at an off-site meeting point five (5) hours prior to the kick-off of the allocated matches. They should be collected by the Winner or other parent/guardian/team Coach from the same meeting point following the completion of each match.

For reference, the matches are scheduled as follows:

Auckland: Thursday 20 July, Saturday 22 July, Monday 24 July, Wednesday 26 July, Sunday 30 July, Tuesday 1 August, Saturday 5 August, Friday 11 August, Tuesday 15 August

Dunedin: Friday 21 July, Sunday 23 July, Wednesday 26 July, Friday 28 July, Sunday 30 July, Tuesday 1 August

Wellington: Friday 21 July, Sunday 23 July, Tuesday 25 July, Thursday 27 July, Saturday 29 July, Monday 31 July, Wednesday 2 August, Saturday 5 August, Friday 11 August

Hamilton: Saturday 22 July, Tuesday 25 July, Thursday 27 July, Monday 31 July, Wednesday 2 August

Please ensure that you and the whole Team are able to attend the above dates and timings before submitting your entry and before accepting the Prize.

  1. The Prize does not include any travel including but not limited to travel to the match venue, or any accommodation in the relevant city.
  2. Any costs associated with entering the Promotion are the responsibility of the entrants.
  3. Any additional costs associated with the Prize or prize fulfilment (including but not limited to travel to and from the event, drinks, transfers, spending money, travel/health insurance and any and all other incidental and/or ancillary costs) are the sole responsibility of the winners. The winners are solely responsible for ensuring that they and the Minor/Team are able to travel to the Event.
  4. The Prize is subject to the terms and conditions of FIFA, Eden Park, Dunedin Stadium, Wellington Regional Stadium and/or Waikato Stadium (Prize Suppliers). Without affecting consumers’ rights under the Consumer Guarantees Act 1993, the Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as the result of the conduct of the Prize Suppliers.
  5. The Prize will be awarded to the Entrant on the Team’s behalf. The winner or a nominated Team representative/parent/legal guardian must accompany the winner as their companion as set out in section 13 above.  Winners agree to provide such personal information relating to the team members as is necessary for the purpose of the Prize and/or the Activities.. 
  6. Before the prize is awarded, the winners may be required to sign a release and indemnity agreement, the terms of which will be determined by the Promoter in its absolute discretion. Failure to sign the release and indemnity agreement will result in disqualification from eligibility as the winner of the Prize.  
  7. The Promoter will use all reasonable efforts to contact an entrant selected as a winner but accepts no responsibility if an entrant cannot be contacted. If an entrant selected as a winner cannot be contacted, or is unable to accept any element of the Prize or is disqualified from eligibility as the winner of the Prize pursuant to these Terms and Conditions, then that entrant will forfeit the Prize in its entirety and the entrant with the next best entry (as determined by the judging panel) will be selected as the winner.  The Promoter will not be liable for a winner who cannot be contacted or is disqualified from eligibility and therefore forfeits their Prize and no correspondence will be entered into.
  8. In the event that a winner forfeits the prize, an alternative winner will be selected by the panel of judges in accordance with the criteria set out in clause 10.
  9. Each Prize must be taken as stated and no compensation will be payable if a winner is unable to use the Prize, or any element of it, as stated. The Promoter reserves the right to substitute the Prizes in whole or in part for something of equal or greater value in the event that any component of the Prize is unavailable (subject to any applicable legislation) despite the Promoter’s reasonable endeavours to procure the Prizes.  Prizes are not transferable, deferrable, exchangeable or redeemable for cash or product.  The Prize cannot be sold to any other person (including by online auction or private sale).   Unused portions of Prizes will be forfeited and no compensation will be payable in lieu of that element of the Prize.
  10. The uniform and footwear will be given to the Team members in person at the Training Day Once Prizes have been given to the Team, the Promoter takes no responsibility for Prizes damaged, delayed or lost in transit, to the extent permitted by law.
  11. Nothing in these Terms and Conditions limits, excludes or modifies any rights under New Zealand law, including under the Consumer Guarantees Act 1993. Except for any liability that cannot by law be excluded (in which case that liability is limited to the maximum extent allowable by law), the Promoter (including its officers, employees and agents) excludes all liability for any death, personal injury, loss or damage (including loss of opportunity and whether direct, indirect, special or consequential) suffered or incurred by any person (whether or not arising from any person's negligence) arising in any way out of or in connection with the promotion, the awarding or provision of any prizes, use of or participation in any of the prizes or the marketing of the promotion.

  12. To the extent permitted by law, and without affecting consumers’ rights under the Consumer Guarantees Act 1993, the Promoter makes no representations or warranties, express or implied, regarding the quality or suitability of the Prize awarded as part of this Promotion and will not be responsible for breach of such representations or warranties. 
  13. The Promoter reserves the right to disqualify any entries in its reasonable discretion. For example, the Promoter may disqualify: (a) any entrants or entries that tamper with, or attempt to tamper with the entry process; (b) incomplete, indecipherable or illegible entries or entries containing  false information or incorrect contact details; (c) any entries that contain material that is obscene, indecent, objectionable, defamatory, libellous or otherwise contravenes an applicable law or infringes any third party's rights; and (d) any entries that the Promoter reasonably considers inappropriate for any reason.
  14. The Promoter reserves the right, at any time, to verify the validity of entries and the details provided by entrants (including an entrant’s or Minor’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions. The identification necessary for verification is at the reasonable discretion of the Promoter.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  15. All entrants who are selected as winners consent to the Promoter using their and/or the team members’ name, image, likeness, character, voice or anything else that identifies them without remuneration in any media worldwide (including without limitation in national print media, on the Promoter's website and in other promotional material) for a reasonable time to publicise this promotion (including any outcome).
  16. Privacy Statement. The Promoter collects entrants' personal information and the personal information of the Minors, and may disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize Suppliers and related bodies corporate, in order to conduct, administer and publicise the promotion.  By entering the promotion, entrants consent to the Promoter using their personal information and the personal information of the Minors and sending them information in accordance with the Promoter's Privacy Policy (https://www.adidas.co.nz/help-topics-privacy_policy.html) and otherwise agree to the terms of the Promoter's Privacy Policy.  This includes sending entrants information about adidas Group products.  Entrants can advise the Promoter at any time if they no longer wish to receive marketing communications from the Promoter, by contacting the Promoter at the address below or in accordance with the Promoter's Privacy Policy.  Some of the Promoter's agents, contractors, service providers, prize suppliers and related bodies corporate may be located overseas, including in Australia and/or Germany, Netherlands, Switzerland and/or Austria, and as a result the entrant's personal information may be disclosed overseas.  If an entrant does not provide the information requested, they may not be able to enter the promotion.   The Promoter's Privacy Policy contains information about how entrants can gain access to or seek correction of personal information that the Promoter holds about them.  It also contains information about how entrants can make a privacy complaint and how the Promoter will deal with it. The Promoter will take reasonable steps to ensure that the third parties to whom the Promoter discloses personal information are bound to protect the privacy of that personal information.
  17. Each entrant must comply with these Terms and Conditions. Each entrant indemnifies and will keep indemnified the Promoter in relation to all loss and damage whatsoever which is suffered (including but not limited to indirect or consequential loss) by the Promoter as a direct or indirect result of the entrant acting inconsistently with or breaching any part of these Terms and Conditions.
  18. The Promoter does not accept any responsibility for late, lost, incomplete, incomprehensible, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. All entries are deemed to be received at the time of receipt in the promotional database.
  19. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination of these, or any other technical failures including any damage to an entrant's (or any other person's) mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion. Entrants acknowledge that the Internet is not a secure medium and that the Promoter is not responsible for the security of on-line entries.
  20. By participating in the promotion, entrants warrant that their entries are original and do not infringe on the intellectual property rights of any third parties. Entrants assign all rights, title and interest to their entry to the Promoter without compensation. The Promoter may, if required, request that an entrant complete any documentation necessary to give effect to this assignment of right, title and interest.
  21. The Promoter accepts no responsibility for any tax implications that may arise from the winning of the prize or the use of the prize. It is the responsibility of each entrant to seek independent advice on the possible implications this may have on their own financial situation.
  22. If for any reason this promotion is not capable of running as planned, or one or more of the matches comprising the Prize are not capable of running as planned, including as a result of epidemics, pandemics, government advisories or requirements, including as a result of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity, safety or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any applicable legislation. Any cancellation, termination, modification or suspension of the promotion will be notified to the winners by email.
  23. The Promoter’s decision on all aspects relating to this promotion is final and no correspondence will be entered into.
  24. If any of these terms and conditions are determined to be illegal, invalid or otherwise unenforceable, then the remaining terms and conditions shall continue in full force and effect.
  25. These Terms and Conditions are governed by the laws of New Zealand.
